Terms of Use

 

The purpose of the following Terms of Use (hereinafter referred to as “this agreement”) is to establish the terms and conditions related to the use of the [Name] service (hereinafter referred to as “this service”, and if the name or content of the service change, the updated services shall all be included) provided by ____________ (hereinafter referred to as “the company”).   • If the content of this agreement differs from the rules in the preceding paragraph or other explanations of this service other than this agreement, the provisions of this agreement shall take precedence. 

 

Article 2 - Registering an account

  • Applicants shall request to register a customer account according to the methods specified by the company. The registration shall be completed after the company decides to accept the request based on standards it has set and gives a notice of approval. 
  • The company may refuse the application’s account registration request if it judges that the request falls under any of the following reasons. The company shall not, however, be obliged to disclose the reason for not approving the registration request. 
  1. If the request includes a false statement, clerical error, or an omission in all or part of the items provided; 
  2. If the applicant is a minor, an incompetent adult, a quasi-incompetent person, or a person in need of assistance, and they have not obtained the consent of a legal representative, aide, guardian, or assistant;
  3. If the company determines that the applicant is part of antisocial forces (e.g., gang, member of a gang, right-wing group, antisocial force, and other equivalents; the same shall apply hereinafter), or that the applicant exchanges with or is involved with antisocial forces by helping with or being involved in the maintenance, operation or management of anti-social forces through the provision of funds;
  4. If the company determines that the applicant is a person who has violated a contract with the company in the past or is a related person thereof;
  5. If the applicant has been subject to measures of Article 8; or,
  6. If the company determines that it is not appropriate to accept the account registration request.
  • If there is a change in the items provided upon registration, the user shall notify the company of these updates without delay by using a method chosen by the company. 
  • The company shall not be liable for any damages caused to the user or a third party due to the user failing to notify the company of the updated items specified in the preceding paragraph.


 

Article 3 - Managing the user ID and password

  • The user shall be responsible of managing their user ID and password. 
  • The user must not, under any circumstances, transfer or lend their user ID or password to a third party.
  • If a user logs in to an account using the correct combination of user ID and password, the company shall consider that it is the account owner who is using the account. 
  • The user shall be liable for damages caused by insufficient management, mistake in use, or use by a third party of their user ID or password, and the company shall not be liable in any circumstances.

 

Article 4 - Usage fee and payment method

  • Users shall pay the usage fee displayed on this website by the company in exchange for using this service, following the method specified by the company. 
  • The company may change the usage fee during the user’s service usage period. 
  • If a user does not pay the usage fee by its due date, they must pay a late fine at a rate of 14.6% per year.

 

Article 5 - Using this service

The following are this service’s usage conditions: 

  1. Listed price: tax-inclusive prices
  2. Shipping fee and COD fee: As specified in the attached table.
  3. Contract enactment date: The contract enters into force once the user receives an order confirmation email from the company. 
  4. Purchase receipt: The receipt is replaced with an order confirmation email.
  5. Shipping address: Shipping address must be within Japan. . 
  6. Shipping period: Usually within approx. 1-2 weeks after receiving the purchase request.
  7. Cancellations: Cancellations are only accepted if the shipped item is defective or different from the ordered item. (Given that the user contacts the company within 8 days after the item is delivered.)
  8. Notwithstanding the previous paragraph, the company cannot accept cancellations, returns, or exchanges for the following products:
  • Products that have been unpacked and used.
  • Products that have been received more than 8 days ago.
  • Products that have been damaged or stained by the customer.
  • Products that are not packaged (bag, case, etc.). 
  • Custom-made products, such as products especially made for the customer or personalized products. 
  • Any other products that have been marked as non-returnable in their product description page.

The company shall bear the shipping costs for returned goods if there is a clear defect in the product or if the wrong product was sent out. The customer shall bear the shipping costs if the return or exchange is due to any other reason. 

  1. Guarantee: Except for the cases mentioned above, the company does not guarantee the quality or performance of the products sold. 
  2. Other precautions: 
  • The company may fail to ship products that are sold in limited quantities if it runs out of stock.
  • Products shown on the website may slightly differ from the products customers will receive due to changes in manufacturing specifications.
  • Products may look different from the product images posted on the website. 

 

Article 6 - Prohibitions

Users must not partake in the following acts when using this service:

  1. Acts that violate laws and regulations or public order and morals;
  2. Acts related to criminal activity;
  3. Acts that infringe intellectual property rights, portrait rights, privacy rights, honor, or other rights or interests of the company, other service users or other third parties;
  4. Acts that destroy or interfere with the functions of the company's server or network;
  5. Acts that may interfere with the operation of the company’s services;
  6. Collecting or using the personal information of other users;
  7. Impersonating other users;
  8. Acts that directly or indirectly benefit antisocial forces in connection with the company’s services;
  9. Acts that go against the purpose of use of this service;
  10. Acts that directly or indirectly induce or facilitate the preceding items; or,
  11. Other acts that the company deems inappropriate.

 

Article 7 - Suspension of services

  • The company may interrupt or suspend the provision of all or part of this service without notifying the user in advance for any of the following reasons:
  1. When performing maintenance work, inspecting or updating the computer system related to this service;
  2. When the computer or communication lines are interrupted due to an accident;
  3. When it becomes difficult to provide this service due to events of force majeure, such as earthquakes, lightning strikes, fires, storms and floods, power outage, or other natural disaster; or,
  4. When the company determines that the suspension or cancellation of this service is appropriate.
    • The company shall not be liable for any disadvantages or damage suffered by the user or a third party due to the suspension or interruption of the provision of this service, regardless of the reason. 

 

Article 8 - Usage restrictions

  • In the following cases, the company may restrict the use of all or part of this service or cancel a user’s account registration after giving prior notice to the relevant user:
  1. If a user violates any of the provisions of this agreement; or, 
  2. If the company judges that the use of this service is not appropriate. 
  • In the following cases, the company may restrict the use of all or part of this service or cancel a user’s account registration without giving prior notice: 
  1. If an account is found to have been created based on false information; or,
  2. If the payments have stopped or have failed, or bankruptcy proceedings, civil rehabilitation proceedings, corporate reorganization proceedings, special liquidation, or similar proceedings have been initiated.
  • In the case of the preceding paragraph, the user naturally loses the benefit of time on all the debts owed to the company and must immediately pay the amount due to the company. 
  • The company shall not be liable for any damage caused to users due to actions taken based on this article.  
 

Article 9 - Account deletion

  • Users may withdraw from this service and cancel their account registration by notifying the company, using the method prescribed.
  • If a user owes any debt to the company upon withdrawal, the user shall naturally lose the benefit of time on the debt owed and shall immediately pay the entire debt back to the company.
  • Regarding the handling of personal information after withdrawal, the company shall comply with the provisions of its privacy policy. 

 

Article 10 - Indemnity

  • The company shall be exempt from all liability, as long as it is not due to its intentional or gross negligence. 
  • Even if the company is liable for any reason, it is only liable for compensation within the range of damages that can usually occur, and within the[price (equivalent to one month’s worth in the case of a continuous service)] range for paid services.
  • The company is not liable for any transactions, communications or disputes that occur between users or third parties regarding this service. 

 

Article 11 - Provision of personal information

  • Regarding the handling of personal information, the company shall comply with related laws and regulations, such as the Act on the Protection of Personal Information (Act No. 57 of 2003), and its privacy policy [(http: // www…)]. 
  • Users shall agree that the company handles their personal information in accordance with its privacy policy.

 

Article 12 - Changing the service 

The company may change the content of this service or discontinue the provision of this service without notifying users, and it shall not be liable for any consequent damage caused to users. 

 

Article 13 - Amending this agreement

  • The company may change this agreement at any time without notifying users if it deems it necessary. 
  • When amending this agreement, the company shall notify users of the updates by posting a notice on its website’s home page or the pages linked to the home page. After notifying users of the change, if users use the service or do not delete their account within [7 business days after the notice was posted], they will be deemed to have agreed to the newly amended agreement. 

 

Article 14 - Notice and contacts

Notifications or communication between users and the company shall be made using a method chosen by the company. 

 

Article 15 - Prohibition to transfer rights and obligations

Users may not transfer or provide as collateral to a third party their status under the usage agreement or their rights or obligations based on this agreement without the company’s prior written consent.

 

Article 16 - Governing law and jurisdiction

  • Japanese law shall govern when interpreting this agreement.
